WASHINGTON (AP) -- The Supreme Court declared Friday that same-sex couples have a right to marry anywhere in the United States.
Gay and lesbian couples already could marry in 36 states and the District of Columbia. The court's 5-4 ruling means the remaining 14 states, in the South and Midwest, will have to stop enforcing their bans on same-sex marriage.
Gay rights supporters cheered, danced and wept outside the court when the decision was announced.
Justice Anthony Kennedy wrote the majority opinion, just as he did in the court's previous three major gay rights cases dating back to 1996. It came on the anniversary of two of those earlier decisions.
The four dissenting justices each filed a separate opinion explaining their views, but they agreed that states and their voters should have been left with the power to decide who can marry.

First defining marriage is not one of the powers enumerated in the constitution as belonging to the Federal Government.
Second this will be used in an attempt to force churches and temples to perform gay marriages. It will also be used to further socially and economically marginalize observant Christians and Jews.
Third IMHO what we in the US call marriage ought to be split into two parts: . a civil union that defines a couple's relationship to the state, taxes, inheritance, etc. . the word marriage would then be reserved for those couples who have their union sanctioned by their church or temple.
Here in NJ we have civil unions that carry all the rights and responsibilities that are associated with marriage in the US. BUT that is not what this is all about; that is not enough; activist homosexuals serve as useful idiots who want and demand marriage.
We are forcibly being transformed into Rome during the days of Caligula.
"The Supreme Court’s landmark 5-4 decision Friday establishing a right to same-sex marriage is a “threat to democracy,” with five justices effectively asserting themselves as rulers over the nation, warned Associate Justice Antonin Scalia in one of four dissenting opinions.
Joined by Associate Justice Clarence Thomas, Scalia said the “substance of today’s decree is not of immense personal importance to me,” reasoning that the law “can recognize as marriage whatever sexual attachments and living arrangements it wishes, and can accord them favorable civil consequences, from tax treatment to rights of inheritance.”
While conferring the name of marriage to same-sex relationships can have adverse social effects, he acknowledged, they are no more “adverse than the effects of many other controversial laws.”
“So it is not of special importance to me what the law says about marriage,” he said.
“It is of overwhelming importance, however, who it is that rules me. Today’s decree says that my Ruler, and the Ruler of 320 million Americans coast-to-coast, is a majority of the nine lawyers on the Supreme Court,” Scalia wrote."
"Thomas, joined by Scalia, wrote that Friday’s decision “is at odds not only with the Constitution, but with the principles upon which our Nation was built.”
“Since well before 1787, liberty has been understood as freedom from government action, not entitlement to government benefits,” he said.
“The Framers created our Constitution to preserve that understanding of liberty,” Thomas wrote. ‘Yet the majority invokes our Constitution in the name of a ‘liberty’ that the Framers would not have recognized, to the detriment of the liberty they sought to protect.”
The court’s majority, Thomas said, “rejects the idea — captured in our Declaration of Independence — that human dignity is innate and suggests instead that it comes from the Government.”
“This distortion of our Constitution not only ignores the text, it inverts the relationship between the individual and the state in our Republic. I cannot agree with it.”
The court is not able to decide religious moral matters. It should have stayed out of this entirely. When it forces on the American people, a judicial decision based on equality, when it's a moral religious decision the people reject, we absolutely have judicial tyranny. In this case five people are imposing their amoral will on the rest of the Nation, on people who have said at the ballot box they are not interested in gay marriage.
