The Justice Department declined to prosecute former FBI Director James Comey following a criminal referral from the agency's independent watchdog, which concluded that Comey had leaked classified information and showed a lack of candor with investigators.

Inspector General Michael Horowitz reached out to prosecutors about one of the memos Comey leaked to a friend, which detailed a conversation he had with President Trump, after he was fired by President Trump in May 2017.

Although prosecutors found the watchdog's findings compelling, they decided against prosecution under classified information protection laws because of there being too much uncertainty surrounding Comey's intent, according to the Hill. A month after he was fired, Comey testified to Congress he had leaked his notes to a friend to give to the media, hoping that it would spark a special counsel investigation.

Clearly there is a double standard.

Intent has never been relevant before Hillary. The law regarding the handling of classified information cares nothing about intent.

I hope that they are saving Comey for prosecution on more serious charges ....well I can dream can't I.

IMHO Comey would look wonderful in orange.

IMHO, to use football terminology, Comey would look good going from tight end to wide receiver...

Here is an excellent comment from a former prosecutor, Bob. It is found under the article cited below on the decision not to prosecute Comey's intentional leaking of a classified document. All I can say is I hope they're thinking they have much bigger fish to fry so they're leaving this lesser infraction alone. TM

As a former prosecutor , declining prosecution of Comey sounds like legal BS to me. The same nonsense rationale Comey used not to prosecute Hillary, lack of intent, is now being used not to prosecute Comey. Intent is not even required. There is a separate espionage section which makes recklessly handling classified material a crime. To me, it reinforces that we have a two tier justice system. A lowly sailor does a year for sending photos of his submarine. Petraeus was convicted of leaking classified. Yer, Comey gets a pass? Why? If Comey is not prosecuted for FISA, then stick a fork in our judicial system because it is corrupt beyond repair. Equal Justice under the law and no one is above the law are myths.
The DOJ May need to officially rename itself THE DEPARTMENT OF JUST US.
I don’t mind playing by the rules when everyone else does including people in positions of power. But I feel like a damn fool following laws when illegal aliens, and the powerful do not. I feel abused.
