Judges behaving like politicians get treated by the public, and even presidents, like politicians. The same gavels with which they defend the First Amendment with a swing do not become with a wave a magic wand granting them immunity from second-guessing and insults. When jurists vote rather than rule on cases, people naturally get on their case. The hectoring became especially elevated in recent days because judges not only usurped a legislative power by setting a policy but invalidated national security responsibilities traditionally entrusted to the president. The outrage involves not this policy but this president.

Judge Gorsuchís instruction proves helpful here.

ďIt is the role of judges to apply, not alter, the work of the peopleís representatives,Ē Gorsuch said upon his nomination. ďA judge who likes every outcome he reaches is very likely a bad judge stretching for results he prefers rather than those the law demands.Ē

If only we were able to deport citizens, we could use Trumpís new policy of excluding those who are ďhostileĒ toward our country to get rid of Judge James Robart.

Judge Robartís veto of Trumpís travel ban notwithstanding, there is not the slightest question but that the president, in his sole discretion, can choose to admit or exclude any foreigners he likes, based on ďthe interests of the United States.Ē

To review:

When the presidentís immigration policy is to promote international communism: The president wins.
When the presidentís immigration policy is to transform America into a different country: The president wins.
But when the presidentís immigration policy is to protect Americans: Some piss-ant judge announces that his authority exceeds that of the president.
